By registering/creating an account on the Builds.io website, you are indicating your acceptance of the following terms and conditions («Terms of Service») of the «Service» provided on this website. If you’re agreeing to this agreement for a company or some other legal entity, you’re vouching that you’ve got permission to represent that entity, its affiliates, and anyone using our services through your account. In this scenario, «you» means the entity, its affiliates, and its users. If you don’t have permission to represent them, or if you don’t agree with these terms, then you cannot accept this agreement and can’t use our services.

If Builds.io makes any material changes to these Terms, we will provide notice to you via email or by posting a notice on our website prior to the changes taking effect. Any new features that enhance or expand the current Service, including the release of new tools and resources, will also be subject to these Terms of Service. Your continued use of the Service after any such changes will be deemed as your consent to the updated terms. It is your responsibility to review the most current version of the Terms of Service, which can be found at https://builds.io/legal/terms.

Violation of any of the terms outlined below may result in the termination of your Account. While Builds.io prohibits certain conduct and Content on the Service, you acknowledge and agree that Builds.io cannot be held responsible for the Content posted on the Service and that you may be exposed to such materials. By using the Service, you agree to do so at your own risk.

A. Account Terms

You must be at least 16 years old to access the Service.

Accounts registered by bots or other automated methods are strictly prohibited.

During the registration process, you must provide your name, a valid email address, and any other requested information.

Each login is strictly for individual use. Multiple people are not allowed to use the same login.

To complete the registration process for your device with your Builds.io account, you must allow the Service to install a configuration profile on your device.

Only devices in «Active» status can install apps. A device is considered «Active» when it is registered within a Developer Certificate, the certificate has not been revoked, and your device is not in «Processing» or «Ineligible» status.

It is your responsibility to ensure the security of your account and password. Builds.io cannot be held liable for any loss or damage resulting from your failure to comply with this security obligation.

You are responsible for all activities that occur under your account.

Your Builds.io account may not be used for any illegal or unauthorized purposes. By using the Service, you agree not to violate any laws in your jurisdiction, including copyright or trademark laws. If you are a copyright holder of Content, please contact us via legal@builds.io.

B. Payment, Refunds, and Subscription Terms and Conditions

When you purchase a subscription, your device may undergo «Processing» or «Ineligible» statuses, as determined by Apple.

If your device is placed in a «Processing» or «Ineligible» status, we provide options for compensation: a promo code or the ability to pause your subscription. To request compensation, simply reach out to our Support team via help@builds.io.

The activation process for your device begins as soon as you set up your profile after completing the subscription payment.

The activation process can take anywhere from one hour to three days. This timeframe is necessary to register your device within the Developer Certificate and for Apple to verify it. If you have any questions about the registration process of your device, don’t hesitate to contact our Support team via help@builds.io.

Each subscription is valid for one device only. Paid and activated subscriptions cannot be transferred from one device to another. Separate subscriptions must be purchased for each new device.

Our service is available for access through a monthly subscription, offering three distinct Plans for purchase:

• Standard Plan priced at $19.99
• Adult Plan priced at $9.99
• Full Access Plan priced at $19.99

For each subscription, we provide a minimum of 27 days of service and offer compensation as outlined in item B of these Terms of Service. However, for the actual expiration date of your subscription, please refer to your account’s device and subscription page, accessible by logging in to your Builds.io account.

By purchasing a Builds.io subscription, you understand and agree that we have the right to suspend your subscription at any time without requiring a request from you. Furthermore, if we detect any illegal activity or actions, your subscription will be immediately canceled. Please rest assured that all your account information, including your UDID and email address, will remain strictly confidential. We encrypt this data in our secure database to ensure the utmost security and privacy for all Builds.io users. Additionally, please remember that you are solely responsible for how you download and use the applications provided by Builds.io.

The User has the right to a refund in case we cannot provide the service and cannot resolve the issue within a reasonable timeframe. Upon refund processing, your subscription will be temporarily suspended, and access to the service will be terminated. To initiate the refund process, please reach out to our support team at help@builds.io.

As a valued customer, we kindly ask that you refrain from initiating chargebacks or other payment disputes. We recommend that you contact us, and we’ll try to solve any issues you may have with the Service.

C. Changes to the Service, Pricing, and Subscriptions Plans

At Builds.io, we reserve the right to make changes to the Service, including adding or removing applications, without notice. These modifications may be temporary or permanent.

Please note that the plans and pricing for all our services are subject to change. We will provide you with a 15-day notice before any changes take effect. You can expect to find this notice on the Builds.io website, within the Service itself, or on our official Twitter account (@builds_io).

A monthly subscription will automatically renew unless you cancel it before the next billing period. This will ensure you aren’t charged for the following cycle. If any subscription plan becomes unavailable, we may terminate your ongoing subscription so it won’t renew upon expiration.

Builds.io cannot be held liable to you or any third party for any modifications, price changes, suspensions, or discontinuations of the Service.

D. Copyright and Content Ownership

The Builds.io website and all its content are the exclusive property and trademarks of Builds.io.

The Apple logo and all device names are the property and trademarks of Apple, Inc.

Please note that any content provided by third-party vendors belongs to the respective vendor. These third-party providers are solely responsible for the content they provide, including advertising and sales of exclusive in-app content. Builds.io is not an app developer and does not have control over or responsibility for the content of third-party apps.

We have the right to remove any Content or accounts that, in our sole discretion, are deemed unlawful, abusive, threatening, libelous, defamatory, or otherwise objectionable or that violate any party’s intellectual property rights or our Terms of Service.

If you believe that any content on the Builds.io website infringes your copyright, you (or your authorized agent) can send us a notice at legal@builds.io. In your notice, please include the following information:

• The electronic or physical signature of a person authorized to act on behalf of the owner of the exclusive right that has allegedly been infringed.
• Identification of the copyrighted work or other intellectual property that you claim has been infringed.
• A description of where the infringing material is located on the site, with sufficient detail to help us locate it.

Upon receiving a valid notice, we will take appropriate action to remove or block access to the infringing material.

E. General Terms and Conditions

Your use of the Service is entirely at your own risk. The Service is provided on an «as is» and «as available» basis.

Builds.io service support is available in English only via email.

You acknowledge and agree that the Service may contain advertising. You also understand and agree that the Service may include certain communications from Builds.io, such as important service announcements, updates to the Terms of Service, administrative messages, and any communications directly related to the Terms of Service. You have the option to opt out of receiving these communications at any time.

You understand that Builds.io utilizes third-party vendors and hosting partners to provide the necessary hardware, software, networks, storage, and related technology required to run the Service.

You are prohibited from modifying, adapting, or tampering with the Service or modifying another website in a manner that falsely suggests an affiliation with the Service, Builds.io, or any other Builds.io service.

Without Builds.io’s express written permission, you agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, its use, or access to the Service.

You acknowledge that technical processing and transmission of the Service, including your content, may be transmitted unencrypted and may involve (a) transmission over various networks and (b) modifications to meet the technical requirements of interconnected networks or devices.

It is prohibited to download, publish, host, or transmit any unsolicited email, SMS, or «spam» messages.

You must not transmit any worms, viruses, or any code of a destructive nature.

If your bandwidth usage significantly exceeds the average bandwidth usage of other Builds.io customers (as determined solely by Builds.io), we reserve the right to immediately disable your account until you can reduce your bandwidth consumption.

Builds.io does not warrant that (i) the Service will meet your specific requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results obtained from using the Service will be accurate or reliable, (iv) the quality of any products, services, information, or other materials obtained through the Service will meet your expectations, or (v) any errors in the Service will be corrected.

You explicitly understand and agree that Builds.io shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for lost profits, goodwill, use, data, or other intangible losses (even if Builds.io has been advised of the possibility of such damages), resulting from (i) the use or inability to use the Service, or (ii) the cost of acquiring substitute goods and services arising from the purchase or half.

The failure of Builds.io to enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitute the entire agreement between you and Builds.io and govern your use of the Service, superseding any prior agreements between you and Builds.io (including any prior versions of the Terms of Service). By using the Service, you agree to be bound by these Terms of Service.

Adult Content Policy

In certain instances, our Service may feature content designed specifically for individuals aged 18 and above (referred to as «Adult Content»). This content may include explicit material and content that may not be suitable for all audiences.

A. Prohibited Content on Our Service:

Content containing any of the following is prohibited from the Service:

• Photographs and videos of dead bodies of people or animals.
• Photographs and videos of dismemberment, gore, or cannibalism.
• Photographs and videos depicting humans killing animals if there is no explicit manufacturing, hunting, food consumption, processing, or preparation context.
• Photographs and videos of fetish content that involves acts that are likely to lead to the death of a person or animal; dismemberment; cannibalism; feces, urine, spit, snot, menstruation, or vomit; or bestiality.
• Any content depicting minors in a sexual way or otherwise sexualizing minors.
• Any content depicting rape.
• Any content soliciting sexual activity.
• Any content that includes or promotes discrimination based on sex, racial or ethnic origin, nationality, religion or belief, disability, age, or sexual orientation.
• Any content encouraging behavior prejudicial to health and safety.
• Any content that contains or refers to anyone else’s personal data or private or confidential information (for example, telephone numbers, location information (including street addresses and GPS coordinates), names, identity documents, email addresses, log-in credentials, including passwords and security questions, financial information including bank account and credit card details, biometric data, and medical records) without that person’s express written consent.
• Any content depicting self-harm or suicide.

B. Access to Adult Content

Access to adult content is restricted to individuals who have reached the legal age as defined by the laws and regulations of their respective regions.

We urge users to use our Service responsibly, considering their personal preferences and beliefs.

C. User Responsibilities

Users must acknowledge that access to Adult Content may be limited or prohibited in some jurisdictions. Users are solely responsible for complying with the laws of their country or region.

Users are required not to share access to Adult Content with minors or individuals below the legal age requirement.

D. Limitation of Liability

We shall not be held responsible for any consequences resulting from our users’ use of Adult Content, including instances where such content is accessed by minors due to improper use of credentials or violations of our policies.

E. Content Filtering

To restrict access to Adult content, our platform is equipped with content filtering settings. These settings section the library into various Categories with access to them under different conditions, with confirmation of the user’s age and intent to access the content. However, it is important to note that the effectiveness of these filters cannot be guaranteed.

F. Reporting Infringements

If a user encounters content they believe to be inappropriate or in violation of our policies, we request that they report it to us at legal@builds.io.
