Terms of Service

By registering for or creating an account on the Builds.io website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity and its users. If you do not have such authority or do not agree to these Terms, please do not use the Service.

Important: These Terms, along with our Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and Builds.io regarding your use of the Service.

Disclaimer: Builds.io is an independent service and is not affiliated with, endorsed by, or in any way officially connected to Apple Inc. The use of Apple trademarks and references to Apple's Development Program is solely for descriptive purposes.

1. Definitions

For the purposes of these Terms, the following definitions apply:

Service: The platform provided by Builds.io that enables users to register iOS devices in the Apple Development Program and install applications on these devices.

Account: The personal account you create to access and use the Service.

Device Activation: The process by which your iOS device is registered with Apple's Development Program, transitioning it to an "Active" status.

Active: A status indicating that your device is registered within Apple's Development Program and is eligible to install apps.

Processing: A temporary status (lasting from 0 to 3 days) that occurs when your device is added to a new developer certificate; during this time, installing applications via certificate is paused as Apple performs background checks on your device.

Ineligible: A status imposed when Apple revokes the developer certificate associated with your device. The device remains ineligible for:

  • 14 days for the first revocation
  • 30 days for each subsequent revocation

Configuration Profile: A software profile installed on your device that allows Builds.io to access your device's unique identifier (UDID), product type (e.g., iPhone, iPad), and version information. This profile is essential for linking your subscription to your device and facilitating the app installation process.

App Catalog: The full collection of applications available through the Service, including adult content. All Subscription Plans provide access to the complete App Catalog.

Certificate Revocation: The event in which Apple disables the developer certificate associated with your device. Certificate revocation is an inherent risk of all sideloading services and is not specific to Builds.io.

Subscription Plans: The various plans available for accessing the Service. Currently, these include:

  • Starter (Budget) Plan: A one-time purchase providing access to the full App Catalog. Starter certificates have no device slot limits and carry a higher risk of revocation. This plan does not include revoke compensation, device transfers, or processing delay compensation.
  • Light Plan: A one-time purchase providing access to the full App Catalog. Light certificates are limited to 30 device slots, which lowers the risk of revocation. This plan does not include revoke compensation, device transfers, or processing delay compensation.
  • Premium Plan: A recurring subscription (available in 6-month or annual billing cycles) providing access to the full App Catalog. Premium certificates are limited to 30 device slots. This plan includes free device transfers, automatic revoke recovery (new certificate, a free month of service, and full cooldown coverage), and processing delay compensation (a free week).

User Content: Any content you submit, upload, or otherwise provide while using the Service.

2. Acceptance and Modification of Terms

By using the Service, you agree to these Terms. Builds.io reserves the right to update or modify these Terms at any time. In the event of material changes, we will notify you via email and/or by posting a notice on our website at least 15 days before such changes take effect. If you do not agree to the updated Terms, you may terminate your use of the Service prior to the effective date of the changes. Your continued use of the Service following these changes will be deemed acceptance of the updated Terms.

3. Account Registration and Security

Eligibility: You must be at least 16 years old to create an account. Access to Adult Apps or content is restricted to users who are of legal age in their jurisdiction.

Registration Requirements: During registration, you must provide your name, a valid email address, and any other requested information.

Individual Use: Each account is for individual use only. Sharing your login credentials with multiple people is prohibited.

Configuration Profile and Associated Risks: To complete the device registration and activation process, you must install the provided configuration profile. This profile allows us to obtain your device's UDID, product type, and version to properly link your subscription to your device. By installing this configuration profile, you acknowledge and accept the potential risks associated with installing third-party software on your device. Builds.io is not liable for any adverse effects on your device's security or functionality resulting from the installation or operation of the configuration profile.

Account Security: You are responsible for maintaining the security of your account and password. Builds.io is not liable for any loss or damage resulting from your failure to protect your account.

4. Device Activation Process

Activation: Device Activation is the process by which your iOS device becomes "Active" in Apple's Development Program, enabling app installation.

Statuses:

  • Processing: After adding your device to a new developer certificate, your device enters "Processing" status for up to 3 days while Apple performs background checks. During this time, app installation via certificate is paused.
  • Ineligible: If Apple revokes your device's associated developer certificate, your device becomes "Ineligible" for a waiting period — 14 days for the first occurrence and 30 days for subsequent occurrences — during which app installation via certificate is disabled.

Responsibility: It is your responsibility to monitor your device's status through your account dashboard.

Device Transfer and Cancellation: Each plan is valid for one device only.

  • Premium Plan: You may transfer your subscription to a different device at no additional cost. Contact our support team at help@builds.io to verify your identity and complete the transfer.
  • Light and Starter (Budget) Plans: Device transfers are not included. To use the Service on a different device, you must purchase a separate plan for that device, or upgrade to the Premium Plan. Loss of access to your registered device or inability to install the configuration profile does not constitute grounds for a refund or free transfer under these plans.

5. Certificate Revocation and Risk Disclosure

General Risk: Sideloading relies on developer certificates issued through Apple's Development Program. Apple may revoke these certificates at any time and for any reason. Certificate revocation is a risk inherent to all sideloading services and is not specific to Builds.io. Your chosen Subscription Plan determines what protection and compensation you receive in the event of a revocation.

Starter (Budget) Plan Risks: Starter certificates have no device slot limits, which means they may be shared among a larger number of devices. This results in a higher probability of certificate revocation. A Starter certificate may remain valid anywhere from one month to over a year — there is no way to predict its lifespan. This plan does not include revoke compensation, certificate replacement, free time, or any recovery assistance.

Light Plan Risks: Light certificates are limited to 30 device slots, which reduces the probability of revocation compared to Starter certificates. However, revocation may still occur. This plan does not include revoke compensation, certificate replacement, free time, or any recovery assistance. If your Light certificate is revoked, you may purchase a new plan or upgrade to Premium.

Premium Plan Protection: If your Premium certificate is revoked, Builds.io will:

  • Move your device to a new certificate as soon as possible.
  • Add a free month of subscription time to compensate for the disruption.
  • Cover the entire Apple-imposed cooldown period (14–30 days) with free subscription time, so you never lose a paid day.

Processing Delays: When a device is added to a new certificate, Apple may impose a Processing period of up to 3 days. Premium Plan subscribers are eligible for a free week of subscription time to compensate for processing delays. Starter and Light Plan subscribers are not eligible for processing delay compensation.

Acknowledgment: By purchasing any Subscription Plan, you acknowledge that you understand the risks associated with certificate revocation and the level of protection provided by your chosen plan.

6. Payment and Subscription Terms

Subscription Plans: You may purchase one of the following Subscription Plans:

  • Starter (Budget) Plan: A one-time payment. Provides access to the full App Catalog for the lifetime of the assigned certificate.
  • Light Plan: A one-time payment. Provides access to the full App Catalog for the lifetime of the assigned certificate.
  • Premium Plan: A recurring subscription billed every 6 months or annually. Provides access to the full App Catalog with full protection benefits as described in Section 5.

One-Time Payments vs. Subscriptions: Starter and Light Plans are one-time purchases and do not renew automatically. The Premium Plan is a recurring subscription that renews automatically unless canceled before the next billing cycle.

Activation Timing: Your device activation process begins as soon as you set up your profile after completing payment.

Payment Disputes: We ask that you contact us directly to resolve any issues before initiating chargebacks or other payment disputes. Refund requests will be handled according to the guidelines set forth in Section 7.

Plan Limitation: Each plan is valid for one device only. Device transfers are available only under the Premium Plan, as described in Section 4.

7. Refund Policy

At builds.io, we are committed to providing a caring and responsive service. Our refund policy reflects the different levels of protection offered by each Subscription Plan.

General Principle

A refund may be issued if you are unable to use the Service due to a problem on our side and the issue is not resolved within a reasonable timeframe (at least one business week). We will work with you to address any difficulties and offer alternative solutions before processing a refund.

What Does NOT Constitute Grounds for a Refund

The following circumstances are inherent to the nature of the Service and do not qualify as grounds for a refund under any Subscription Plan:

  • Processing status (up to 3 days): A standard Apple review process that affects approximately 60% of new devices. This is imposed by Apple and is not a malfunction of the Service.
  • Ineligible status (up to 30 days): An Apple-imposed cooldown period following certificate revocation. This is set by Apple and is not within our control.
  • Certificate revocation: An inherent risk of all sideloading services, as described in Section 5. Revocation of a certificate does not constitute a failure of the Service.
  • Absence of compensation or certificate replacement under Light and Starter (Budget) Plans: These plans do not include revoke compensation or certificate replacement by design. The absence of these features is a characteristic of the chosen plan, not a deficiency of the Service.
  • Device change or loss of access to a device: Changing, losing, or being unable to access your registered device is not a Service-related issue.

Premium Plan Compensation

Premium Plan subscribers do not receive monetary refunds. Instead, all downtime is compensated with free subscription time:

  • Processing delays: a free week of subscription time.
  • Certificate revocation: a free month of subscription time, immediate transfer to a new certificate, and full coverage of the Apple-imposed cooldown period.
  • Any other service disruption: free subscription time proportional to the duration of the issue.

Light and Starter (Budget) Plan Refunds

Light and Starter Plans are one-time purchases. These plans do not include monetary refunds, subscription pauses, or downtime compensation. Your plan covers the lifetime of the assigned certificate. If a certificate is revoked, you may purchase a new plan or upgrade to the Premium Plan.

Payment Disputes

We ask that you contact us directly to resolve any issues before initiating chargebacks or other payment disputes. The same principles described above apply in the case of payment disputes.

General Conditions

All refund decisions are made in good faith and based on documented service issues.

Nothing in this Refund Policy limits your statutory rights under applicable consumer protection laws.

8. Limitation of Liability and Disclaimers

"As Is" Basis: The Service is provided on an "as is" and "as available" basis without any warranties, express or implied.

Disclaimers: To the maximum extent permitted by law:

  • Builds.io does not guarantee that the Service will meet your specific requirements or be uninterrupted, timely, secure, or error-free.
  • Builds.io is not liable for any direct, indirect, incidental, special, consequential, or exemplary damages (including lost profits, goodwill, use, data, or other intangible losses) arising from your use of the Service or your inability to use it.

Limitation of Liability: To the maximum extent permitted by applicable law, our total liability arising from or related to your use of the Service shall not exceed the total amount you paid for the Service during the three months immediately preceding the claim. Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury resulting from our negligence.
  • Gross negligence or willful misconduct.
  • Any other liability that cannot be excluded by law.

Bandwidth and Usage: Builds.io reserves the right to take action if your bandwidth usage is deemed to impair the performance of the Service for other users. (Any specific thresholds or measures will be provided separately if applicable.)

9. Indemnification

You agree to indemnify, defend, and hold harmless Builds.io, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising from your misuse of the Service or your violation of these Terms, except to the extent that such claims arise directly from our gross negligence or willful misconduct.

10. Governing Law and Dispute Resolution

Governing Law: These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the State of Delaware, USA. Notwithstanding the foregoing, if you are a consumer as defined by applicable law, you may have the right to bring certain claims in your local jurisdiction.

Dispute Resolution: Any dispute arising under or in connection with these Terms, except for claims that cannot be arbitrated as a matter of law, shall be resolved by binding arbitration administered by a recognized arbitration organization in accordance with its rules. The arbitration shall be conducted in Delaware unless you and Builds.io agree otherwise. The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Each party shall bear its own costs, except as otherwise provided by the applicable arbitration rules.

11. Privacy and Data Protection

Your privacy is important to us. We collect certain personal information, including your device UDID, email address, and other details provided during registration, in accordance with our Privacy Policy. We implement industry-standard security measures to protect your data. If you are an EU resident, you have additional rights under the General Data Protection Regulation (GDPR).

12. User Content and License

User Content: Any content you submit, upload, or otherwise provide ("User Content") remains your property. However, by submitting User Content, you grant Builds.io a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and distribute such content in connection with the Service.

Representations: You represent that you have all necessary rights to grant this license and that your User Content does not infringe on any third-party rights.

13. Termination

Either party may terminate these Terms upon notice if the other party materially breaches these Terms and fails to cure such breach within 30 days of receiving notice. Upon termination:

  • Your access to the Service will be disabled.
  • Any fees paid are non-refundable unless otherwise provided herein.
  • The provisions of these Terms that by their nature are intended to survive termination (including but not limited to provisions regarding liability, indemnification, and intellectual property) shall continue in full force and effect.

14. Changes to the Service, Pricing, and Subscription Plans

Modifications: Builds.io reserves the right to modify or discontinue any aspect of the Service, including adding or removing applications, at any time without prior notice.

Pricing: Plans and pricing are subject to change. In the event of pricing changes or modifications to Subscription Plans, we will provide notice on the Builds.io website, within the Service, or via our official Twitter account (@builds_io).

Automatic Renewal: The Premium Plan is a recurring subscription that will automatically renew unless canceled prior to the next billing cycle. Starter (Budget) and Light Plans are one-time purchases and do not renew automatically. If a plan becomes unavailable, we may terminate your ongoing subscription to prevent automatic renewal.

15. Miscellaneous

Third-Party Services: The Service may incorporate or rely on third-party vendors and hosting partners. Builds.io is not responsible for failures or issues arising from these third-party services.

Modifications to the Service: Builds.io reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice.

Communications: By using the Service, you agree to receive communications from Builds.io, including service announcements, updates, and administrative messages. You may opt out of certain communications at any time.
